“Auto de infração aplicado sem notificação prévia é nulo. O entendimento, já consolidado nos tribunais do país, foi usado pela 1ª Turma Cível do Tribunal de Justiça do Distrito Federal para manter a decisão da 7ª Vara da Fazenda Pública do DF, que declarou nulos os autos de infração aplicados pelo DFTrans sem notificação prévia.
O motorista entrou com ação contra a DFTrans para anular de duas multas de trânsito sofridas, por aliciamento irregular de passageiros, que afirma terem sido aplicadas quando dava carona a seus vizinhos, nos dias 10 e 19 de agosto. A primeira instância acolheu o pedido. O DFTrans e o Detran-DF recorreram. Argumentaram que as declarações apresentadas pelo autor, na tentativa de provar que estava dando carona, são insuficientes para afastar a presunção de legitimidade e legalidade dos atos administrativos de aplicação de multas, por serem contraditórias. Afirmaram que as multas foram registradas por servidor do DFTrans, o qual confirmou a ocorrência das infrações, e sustentaram que o autor teve a oportunidade de se defender por meio de processo administrativo.
Outro ponto ressaltado pela Turma foi o de que o motorista só soube das autuações quando tentava vender o veículo para terceiro. Para o TJ, a ausência de notificação sobre as autuações demonstra flagrante ofensa aos princípios do contraditório e ampla defesa, pois não permitiram a oportunidade de apresentar defesa prévia à aplicação das multas, impondo-as unilateralmente e condicionando a liberação da documentação do veículo a seu pagamento prévio.”
