“O atual presidente da OAB paulista, Luiz Flávio Borges D’Urso, admite a possibilidade de concorrer ao terceiro mandato. Em entrevista à revista Consultor Jurídico, D’Urso disse que vai confirmar a candidatura no momento oportuno, ou seja, próximo às eleições, marcadas para novembro deste ano. No entanto, já explica por que se candidataria: um terceiro mandato serviria para atender aos pedidos que colegas fazem em cartas e abaixo-assinados. “Eles pedem para que eu continue os trabalhos na defesa da classe, como a inviolabilidade dos escritórios de advocacia e a criação de uma lei que proíba a prática”, disse.
Não há impedimento legal para um terceiro mandato. O Estatuto da Advocacia (Lei 8.906/94) não limita o número de vezes que o candidato pode se eleger. No entanto, nas últimas três décadas, a manutenção da mesma pessoa por mais de três anos à frente de seccional paulista não tem sido prática comum. Nos últimos 30 anos, apenas D’Urso, eleito em 2004 e reeleito em 2006, e Antônio Cláudio Mariz, presidente da ordem por dois mandatos (1987/1991) quebraram a tradição.
D’Urso lembra, no entanto, que o terceiro mandato é comum nas subseções do interior, de onde recebe apoio. Foi comum também no passado. Desde a sua fundação em 1932 até 1977, apenas sete advogados revezaram a presidência da entidade. Somente o advogado Noé Azevedo permaneceu no cargo durante 13 mandatos. Foram mais de 20 anos na presidência da OAB-SP. Porém, a partir de 1977, não houve mais do que reeleição.
Turma do contra
Carlos Miguel Aidar, ex-presidente da OAB-SP que antecede D’Urso, não vê com bons olhos o terceiro mandato do colega. “Eu lamento. Essa situação demonstra fraqueza da classe. Parece que faltam opções para o cargo. Dessa forma, não caracteriza um rodízio salutar”, afirmou Aidar.
De acordo com o ex-presidente, não existe no estatuto da entidade nada que proíba o terceiro mandato. Mas, segundo ele, a prática de mais de dois mandatos aconteceu em uma época em que entidade e a profissão davam os primeiros passos no Brasil. “Em um passado longínquo, não tinha opção. Eram poucas pessoas na classe e militando na entidade. Hoje, temos mais de 250 mil advogados”, disse.
Para Aidar, ganharia de D’Urso na eleição um candidato que tivesse bom trânsito na classe e respeito entre os advogados. Suas apostas seriam Rui Fragoso (que confirmou candidatura), Alberto Zacharias Toron e Antônio Cláudio Mariz de Oliveira — que foi presidente de 1987 a 1991.
O advogado Rui Fragoso, que concorreu com D’Urso nas eleições passadas, faz coro com Aidar. “É lamentável o perpetuísmo frente à Ordem. É contrariar os princípios da advocacia, já que lutamos para que o presidente Lula não pleiteasse um terceiro mandato”, disse.
Ele rebate a afirmação de que mais de dois mandatos é uma prática comum na OAB-SP. “A tentativa de comparação é pretensiosa. A situação do país era outra. O universo da advocacia também era outro. É algo que aconteceu há mais de 40 anos. Não tem como comparar por diversos aspectos”, afirmou.
Para o advogado Leandro Pinto, que também concorreu à presidência com D’Urso, o terceiro mandato é “absurdo e descabido”. “A Ordem dos Advogados do Brasil sempre foi, e Deus permita que continue sendo, o pilar de nossa democracia. Entretanto, tenho lido, no mar de sangue a que se transformou nossos periódicos, que o atual presidente da OAB-SP vem articulando, a exemplo de Lula, Chaves, Mugabe, dentre outros, se perpetuar no poder”, afirmou ele em uma nota.
Clodoaldo Pacce, que também concorreu à presidência na última eleição, diz que a tentativa de terceiro mandato de D’Urso não o surpreende. “Isso ia acontecer, mais cedo ou mais tarde”, disse. Segundo o advogado, nunca a advocacia esteve tão abandonada quanto na atual gestão e acusou o presidente da OAB-SP de querer usar a entidade “como palanque à candidatura para deputado federal”.
Pacce disse que ainda, se a oposição não chegar a um único nome para concorrer contra D’Urso, pretende concorrer, “mesmo com poucos recursos”.
Fragoso e Pinto confirmaram à revista Consultor Jurídico que serão candidatos nas próximas eleições.”
