“A advogada Sandra Maria Galhardo Esteves é a nova desembargadora do Tribunal de Justiça de São Paulo. A escolha foi feita na noite desta quarta-feira (4/8) pelo governador Alberto Goldman. O chefe do Executivo paulista manteve a decisão no forno por mais de um mês, depois da escolha da lista tríplice do quinto constitucional da advocacia. A indicação sai publicada na edição desta quinta-feira (5/8) do Diário Oficial.
Pela primeira vez, três advogadas integravam uma lista do quinto constitucional da OAB-SP encaminhada ao governador paulista. As candidatas eram: Maria Helena Cervenka Bueno de Assis, Martha Ochsenhofer e Sandra Maria Galhardo Esteves.
Inicialmente a lista foi rejeitada pelo Órgão Especial do Tribunal de Justiça, que não conseguiu concluí-la com um terceiro nome. Na sessão seguinte, o colegiado atendeu ofício dos desembargadores Palma Bisson e Maurício Vidigal, pleiteando que fosse feita nova eleição para a escolha da 3ª lista tríplice, rejeitada na sessão anterior. O argumento foi o de que não havia sido observado o Regimento Interno da corte paulista.
Na primeira votação, as advogadas Maria Helena Cervenka de Assis recebeu 21 votos, Sandra Maria Galhardo Esteves obteve 15, Marta Ochsenhofer, 12 (no terceiro escrutínio), e o procurador do estado Enio Moraes da Silva, 11 (terceiro escrutínio).
No entanto, a maioria dos desembargadores entendeu novo pleito poderia ser feito, porque: o quorum não foi atingido (mais da metade dos 25 desembargadores) e faltou apenas um ou dois votos para completar a lista. O presidente Viana Santos não estava presente na votação.
A tese não contou com o apoio dos desembargadores Artur Marques e Marco César, que ficaram vencidos. Depois de muita discussão, a maioria acolheu a representação de Palma Bisson e Maurício Vidigal, votando apenas os quatro nomes remanescentes da lista.
Foi escolhida a advogada Martha Ochsenhofer, com 18 votos. Os demais candidatos eram: Ênio Moraes da Silva (teve 4 votos) e Eunice de Jesus Prudente e Cesar Eduardo Temer (um voto cada).
A Constituição Federal determina que um quinto dos lugares dos tribunais deve ser composto por membros da advocacia e do Ministério Público, indicados em lista sêxtupla pelos órgãos de representação das respectivas classe.
Depois de recebidas as indicações, o tribunal forma uma lista tríplice, enviando-a ao governador do estado, que tem a prerrogativa de indicar o nome do desembargador de cada lista.”
