“A falta de pagamento de mensalidades não pode impedir ex-aluna de obter seu histórico escolar. O pedido de transferência para outra escola também não pode ser negado. A decisão, dada pelo Tribunal de Justiça de Santa Catarina, obrigou o Colégio Ana Luiza, na cidade de Porto Belo, a emitir os documentos da ex-aluna inadimplente.
A ação proposta pelo Ministério Público foi julgada pela 2ª Câmara de Direito Civil, que confirmou a sentença por unanimidade. A mãe da criança alegou que decidiu transferir a filha de escola justamente por não ter mais condições de arcar com as mensalidades. A escola não quis expedir a documentação porque todos os pagamentos referentes a 2005 estavam em aberto.
Para o MP, no entanto, a direção da escola lesou o direito líquido e certo da ex-aluna, entendimento também defendido pelo relator do processo no TJ-SC, desembargador substituto Jaime Vicari. “Não é lícito negar a expedição e entrega de documento de aluno como meio coercitivo de cobrança de mensalidade escola, sobretudo porque a entidade possui meios próprios e eficazes à cobrança de seus créditos”. Segundo Vicari, a atitude vai de encontro à Lei federal 9.870/99, que disciplina cobranças feitas pelas instituições de ensino.”
