A obrigação de transferir os documentos de um carro é de quem comprou. A afirmação é do juiz Jairo Ferreira Júnior, da comarca de Santa Helena de Goiás (GO), que julgou improcedente a ação de indenização por danos morais proposta por Oswaldo de Souza contra Solange Meris Mendes de Oliveira.
Souza diz que comprou uma caminhonete de Waldez Pires de Souza Júnior. Ela, porém, estava registrada ainda no nome de Solange, a antiga dona. O comprador pediu os documentos. Como não conseguiu, entrou como uma ação para que fosse determinada a transferência com expedição de ofício aos Detran de Goiás e de Minas Gerais. Queria ainda indenização por danos morais.
Ao contestar, Solange garantiu que não era parte legítima para ser pólo passivo do processo. Lembrou que não fez nenhum negócio com Souza, mas com Waldez a quem vendeu a camionete. Por sinal, ela não autorizou a venda do veículo para Souza.
O juiz Jairo Ferreira Júnior afirmou, com base no Código de Trânsito Brasileiro, que o artigo 123, I, parágrafo 1º, define que a responsabilidade pela transferência dos documentos do carro é do comprador.
Ferreira Júnior afirmou também que a negociação entre Solange e Waldez é reconhecida. Além disso, o nome do novo comprador que consta da autorização para transferência de é Eduardo Ferreira de Godoy.
Segundo o juiz, Souza não tinha direito de entrar com a ação, que foi extinta. Ele terá que pagar ainda as custas processuais e honorários.
