“A 6ª Turma do Tribunal Superior do Trabalho seguiu a decisão do Tribunal Regional do Trabalho da 1ª Região que decidiu correta a demissão por justa causa de um empregado após a comprovação de utilização do e-mail corporativo da empresa para troca de mensagens com conteúdo pornográfico. O TST negou provimento ao agravo de instrumento do empregado que buscava reverter a decisão.
O Tribunal Regional, ao negar o seguimento do recurso ao TST, declarou que, diante dos depoimentos do autor da ação e de testemunhas, não restou dúvida de que ele, mesmo sabendo que a sua conduta era proibida na empresa, participava da troca de e-mails com conteúdo inadequado entre um grupo de empregados. Ainda segundo a decisão, ficou comprovado que o trabalhador dispensado não apenas recebeu mensagens de outros colegas como também as enviou, “participando inclusive de um grupo que trocava entre si e-mails com conteúdo pornográfico”.
Ao analisar o agravo de instrumento do empregado, o relator, ministro Augusto César Leite de Carvalho, constatou que a decisão do TRT estava em convergência com o artigo 482, alíneas “b” e “h”, da Consolidação das Leis do Trabalho, pois o juízo fundamentou sua decisão no fato de que a justa causa foi aplicada em decorrência de “incontinência de conduta e ato de indisciplina ou insubordinação, devidamente comprovados”. Dessa forma, entendeu que, para se acolher a tese recursal do trabalhador de não cometimento de ato faltoso, seria necessário o reexame de fatos e provas, procedimento vetado pela Súmula 126 do TST.” *Com informações da Assessoria de Imprensa do TST
